How you may use material on our site

With regard to our website:

  • We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.
  • You may print off one copy, and may download extracts, of any page(s) from our site for your personal use and you may draw the attention of others within your organisation to content posted on our site.
  • You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
  • You must not use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.
  • If you print off, copy, download, share or repost any part of our site in breach of these terms of use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

With regard to charts made using our service and blogs published on our platform:

  • You may also download or export the reports, chartpacks, and/or blogs you create, and/or download the underlying raw data.
  • You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.
  • If downloaded reports, chartpacks, blogs, or raw data includes data from an underlying source, you are obliged to comply with the terms of use of that source.
  • Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged (except where the content is entirely user-generated (such as a blog)), or where you are a subscriber to a paid tier of our service).
  • You may share links to our website or any charts you have created with third parties, in accordance with this agreement.
No text or data mining, or web scraping

You shall not conduct, facilitate, authorise or permit any text or data mining or web scraping in relation to our site or any services provided via, or in relation to, our site. This includes using (or permitting, authorising or attempting the use of):

  • Any "robot", "bot", "spider", "scraper" or other automated device, program, tool, algorithm, code, process or methodology to access, obtain, copy, monitor or republish any portion of the site or any data, content, information or services accessed via the same.
  • Any automated analytical technique aimed at analysing text and data in digital form to generate information which includes but is not limited to patterns, trends and correlations.

The provisions in this clause should be treated as an express reservation of our rights in this regard, including for the purposes of Article 4(3) of Digital Copyright Directive ((EU) 2019/790).

This clause shall not apply insofar as (but only to the extent that) we are unable to exclude or limit text or data mining or web scraping activity by contract under the laws which are applicable to us.

Do not rely on information on this site

We provide a data analysis and visualisation tool and the AI Features. The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. We do not provide any investment advice. You should always check your sources. We are not responsible for outputs created by using our service. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.

Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.

User-generated content is not approved by us

This website may include information and materials uploaded by other users of the site, including reports, chartpacks, blogs, social media pages, video-sharing sites, bulletin boards and chat rooms. This information and these materials have not been verified or approved by us. The views expressed by other users on our site do not represent our views or values.

Research providers and paid subscriptions

Our platform enables independent research providers (“ Providers”) to publish content and offer free or paid subscriptions directly to users. Zola acts as an intermediary platform. We do not pre-review or endorse Provider content, and we do not guarantee the accuracy, completeness, or suitability of any content published by Providers.

All Provider content is nevertheless subject to our Acceptable Use Policy and applicable law. We reserve the right, but are not obliged, to review, remove, edit, or disable access to any Provider content that we reasonably believe breaches these Terms, our Acceptable Use Policy, or applicable law — including, without limitation, content that is unlawful, infringes intellectual property, is defamatory, promotes violence or terrorism, constitutes child sexual abuse material, or otherwise poses a risk to users. We may also suspend or terminate a Provider’s account for such breaches, in which case users’ access to that Provider’s content may be interrupted or withdrawn. Users and Providers can report content concerns using the channels set out in “How to complain about or report content”.

Where you pay for a Provider’s content, the contract for that content is between you and the Provider. Zola processes the payment on the Provider’s behalf via our payments partner (Stripe) and may charge a platform fee; Zola is not the seller of the Provider’s content. Content quality, delivery schedules, and any additional warranties or representations are the Provider’s responsibility.

Your statutory rights

Nothing in these Terms affects or limits your statutory consumer rights under UK law, including rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If a Provider’s content is not as described, not of satisfactory quality, or not fit for a particular purpose made known to the Provider, you may be entitled to a repair, replacement, price reduction, or refund under those laws. These remedies are provided by the Provider as seller; Zola will, on request, help you raise and escalate claims against the Provider.

14-day cancellation right for digital content

For paid subscriptions to Provider content delivered digitally, you have the right to cancel within 14 days of purchase and receive a full refund. This right is lost if you expressly consent, at the point of purchase, to the Provider supplying you with content before the 14-day period ends and acknowledge that you will lose your right to cancel once supply has begun. You will be asked to give or withhold this consent at checkout. If you do not consent, access to paid content will not begin until the 14-day period has expired.

Ongoing subscription cancellation

Outside the 14-day cancellation window described above, you may cancel a paid Provider subscription at any time through your settings. Cancellation takes effect at the end of the current billing period; you will retain access until that date. No pro-rata refund is owed for the unused remainder of a billing period unless the Provider elects to offer one or you are entitled to a refund under “Your statutory rights” above.

If a Provider fails to respond

If you have attempted to raise a refund or quality complaint with a Provider and the Provider has not responded within a reasonable time (ordinarily 14 days) or has unreasonably refused, contact us at help@zolaanalytics.com. Where the Provider is unwilling or unable to honour a valid statutory claim, Zola may, at our discretion, refund the user directly and seek recovery from the Provider under our Provider agreement. This does not make Zola the seller of Provider content.

Not financial advice

Research content made available by Providers is for informational purposes only. It does not constitute investment advice, financial advice, trading advice, or any other sort of advice. You should conduct your own due diligence and consult a qualified professional before making any financial decisions based on Provider content.

Free trials of a paid plan

When you start a free trial of a paid Zola plan, you can use that plan for 14 days. When the trial starts, we tell you the plan and the date it ends.

The trial is free. For up to 5 seats, we do not ask for a card to start it, and we do not charge you during it. Each person can have one free trial.

Teams of more than 5 seats, and anyone who has already had a free trial, do not get a free trial. The plan is billed from the day you subscribe.

During the trial you can use the plan's features within its limits, except top-ups and any features we tell you are not included in the trial.

To keep the plan, add a card in Settings. If you add a card during the trial, your paid plan starts when the trial ends, on the date we show you, and our terms and conditions of supply apply to it. If you cancel before the trial ends, you pay nothing.

If you add a card during your trial to keep the plan, we email you at once with the amount, the date of the first charge and how to cancel. We charge the plan price on the day the trial ends. You can cancel before then and pay nothing.

If you have not added a card when the trial ends, your account is locked. While it is locked, you can sign in to reach Settings, help and the download of your trial articles, and nothing else. Members of your team are locked too.

While your account is locked, you can add a card to keep the plan, which opens your account again at once, or move to the free plan.

If you do neither, your account moves to the free plan automatically 30 days after the trial ends. We email you 3 days before. If that email is sent late, your account moves 3 days after we send it.

When your account moves to the free plan, your work from the trial is kept, but it stays locked until you take a paid plan. Members of your team move to their own free accounts. We do not delete your work because a trial ended.

We may change or end free trial offers for new users at any time. A change does not affect a trial that has already started.

How to complain about or report content

This process applies to all content on our site, including content published by research providers. For refund or quality complaints about a specific Provider, please see “Research providers and paid subscriptions”.

If you wish to complain about any other content, please contact us on info@zolaanalytics.com.

We will use reasonable efforts to:

delete accounts which are being used in an inappropriate manner or in breach of these Terms; and

identify and remove any content that is unlawful, inappropriate, defamatory, infringes intellectual property rights or is otherwise in breach of our Acceptable Use Policy

when we are notified of the same.

If you believe that any content which is distributed or published by the Site is unlawful, inappropriate, defamatory or infringing on intellectual property rights, you should contact us immediately using the contact details above.

Referral Programme

R1 Taking part. If you have a Zola account and are 18 or over, you can refer people to Zola with your referral link, which you find in Referrals. Observers and read-only members cannot take part. If you pay for a Zola plan, the Referral Programme clause of the Terms and Conditions also applies to you.

R2 What you earn. When someone signs up through your referral link and their organisation pays for a Zola plan, you earn 20% of what that organisation pays Zola for its plan, excluding VAT, for 12 months from its first payment. The organisation must be different from your own and must not have paid Zola for a plan before. A free trial earns nothing until the first payment. Refunds and chargebacks are deducted from your earnings.

R3 How we pay you. If you pay for a Zola plan, your earnings first reduce your Zola bill. Each month, earnings above that are paid to your payout account, once they reach £20. Smaller amounts stay in your balance until they reach £20. You set up your payout account in Referrals. Stripe, our payment provider, runs it and checks your identity. We pay in pounds sterling; Stripe may convert the payment into your local currency at its exchange rate.

R4 Where we can pay. We can pay payout accounts only in the countries listed in Referrals. If you live elsewhere, your earnings stay in your balance.

R5 Fraud and misuse. We may withhold or reverse earnings that come from fraud, from referring yourself or your own organisation, from fake accounts, or from a breach of this section. If we do, we tell you why by email, and you can reply to help@zolaanalytics.com to challenge it.

R6 Earnings you have not collected. Your earnings stay owed to you until you set up a payout account. They do not expire. We remind you by email while they are unpaid.

R7 Your details and your tax. Give true and complete details to us and to Stripe, and keep them up to date. You are responsible for any tax on your earnings, including reporting them where you live. If you are registered for VAT, add your VAT number in Referrals; your earnings then include any VAT due on them, and you give us a VAT invoice when we ask. You are not our employee or agent.

R8 Sharing your link. Share your link honestly. Do not send messages that people have not agreed to receive, do not pretend to be Zola or to speak for Zola, and do not make claims about Zola that are not true. Follow the law on marketing messages where you send them. We do not pay anyone where the law forbids it, including under sanctions.

R9 Changes. We may change or end the programme by giving you 30 days' notice by email. Earnings made before the change or the end stay yours and are paid under these terms.

R10 Records. We keep records of your referrals and payments for 6 years, and we send you a monthly statement while you have earnings.

We are not responsible for viruses and you must not introduce them

We do not guarantee that our site will be secure or free from bugs or viruses.

You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

Rules about linking to our site

You may share links to charts created using our service.

You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

Our site must not be framed on any other site.

We reserve the right to withdraw linking permission without notice.

The website in which you are linking must comply in all respects with the content standards set out in our then-current Acceptable Use Policy.

If you wish to link to or make any use of content on our site other than that set out above, please contact us at info@zolaanalytics.com.

You and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.

If you are a business, these terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by English law. We both agree to the exclusive jurisdiction of the courts of England and Wales.
